Terms and Conditions for Access to Fusion Lead Management Software
Introduction
This document outlines the terms and conditions under which members (“Members”) are granted access to the Fusion Lead Management Software (“Software”). By subscribing to the Software, Members agree to comply with these terms and conditions.
Subscription Terms
Eligibility
Access to the Software is available exclusively to Members who have an active subscription to both the Property In A Box Fusion Software and the Fusion Lead Management Software.
Subscription Fees
The standard subscription fee for the Software is AUD $145 per month. However, Members can access the Software at a discounted rate of AUD $50 per month, provided the eligibility requirements are met.
Subscription fees are payable monthly and in advance.
Subscription Requirements
Members must commit to a minimum subscription period of 12 months for both the Property In A Box Fusion Software and the Fusion Lead Management Software.
Members are required to pay their monthly subscription fees for both services on or before the due date to maintain access.
Payment Terms
Payment for the Software must be made via the payment methods specified by Property In A Box.
In the event of payment failure or delay, access to the Software will be suspended until payment is received.
Use of Software
License Grant
Upon successful subscription, Members are granted a non-exclusive, non-transferable license to use the Software for their personal or business purposes.
The Software may not be redistributed, resold, or shared with third parties.
Restrictions
Members shall not modify, reverse engineer, or decompile the Software.
Members agree to use the Software in compliance with all applicable laws and regulations.
Termination
Termination by Member
Members may terminate their subscription after fulfilling the minimum 12-month subscription period by providing written notice to Property In A Box. Termination will take effect at the end of the current billing cycle.
Upon termination, access to the Software will be revoked.
Termination by Property In A Box
Property In A Box reserves the right to terminate a Member’s access to the Software in the event of a breach of these terms and conditions or failure to pay the subscription fees.
Liability and Disclaimers
Limitation of Liability
Property In A Box shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Software.
Disclaimer of Warranties
The Software is provided “as is” and “as available,” without any warranties of any kind, whether express or implied.
General Provisions
Changes to Terms and Conditions
Property In A Box reserves the right to modify these terms and conditions at any time. Members will be notified of any changes via email or through the Software interface.
Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of Victoria, Australia.
